The Situation

A commercial lease at Houndstone Retail Park in Yeovil required forfeiting following non payment of commercial rent. A clear notice needed to be fixed to the premises confirming re-entry under the landlord’s power in the lease and that the site had been secured.

The matter required enforcement-led action to regain control of the unit through forfeiture of lease and to prevent unlawful entry following repossession.

After searching for commercial forfeiture services in Bristol, the client contacted Strikes Property Services Group.

Our Approach

Strikes Property Services Group attended the site to complete re-entry in accordance with the landlord’s power under the lease. To immediately secure the premises, Strikes arranged for a locksmith to attend and change the locks.

Once secured, a Forfeiture Notice dated 15 March 2023 was fixed to the door confirming that re-entry had taken place and the lease was forfeited. A Torts Notice was also erected alongside the Forfeiture Notice. These notices clearly warned that no one may lawfully enter the premises without authorisation from the landlord, and that attempts to enter without authority may be a criminal offence.

While on-site, our team took a detailed inventory of the goods remaining at the site.

Outcome

A full report detailing the repossession, complete with the inventory and photographic evidence, was sent to the client on the same day.

The unit was successfully repossessed and remained closed, with the premises fully secured following re-entry and lease forfeiture. This decisive action even caught local attention, with Strikes Property Services Group’s attendance and the posted notices being reported by SomersetLive.
