The Situation

Strikes Property Services was instructed by a commercial landlord to recover outstanding rent arrears from a tenant operating a retail unit in West Yorkshire. The tenant had fallen into arrears, citing difficult trading conditions, including adverse weather, as a contributing factor.

As of late March 2026, the total outstanding debt amounted to £4,422.97, which comprised £3,840.34 in rent and £582.63 in accumulated enforcement fees. The client required a swift and effective resolution to recover the monies owed under the powers of CRAR. The landlord engaged Strikes Property Services to act on their behalf and enforce the debt.

Our Approach

Following service of the Notice of Enforcement, and no contact from the Tenant an enforcement agent from Strikes attended the commercial premises on the morning of a day in late March 2026. The agent made contact with the tenant and his partner, professionally outlining the purpose of the visit and the total sum due. The legal implications of non-payment under the CRAR process were clearly explained.

Following a period of negotiation, which included the agent viewing, and discussing the tenants bank account statements, monthly accounting figures and observing the situation of stock levels in the retail unit a proposal was offered. The office discussed this in length with the landlord to get their approval. Wanting to assist the tenant and work with the business the Landlord agreed to a manageable payment proposal that suited all parties. It was clear to all, that the business had previously been trading well until the winter and recent events, and as such the business was deemed viable but for the recent struggles.

Outcome

A partial payment was collected, which settled the enforcement fees and a part payment to the landlord. The outstanding balance, consisting of rent arrears, is now subject to a formal payment plan. The outcome secured both the landlord and tenants position, and ensured continuity of the business for the foreseeable but also a regular weekly plan for the landlord of the arears, with all future rent agreed to be paid on time.

The intervention by Strikes Property Services secured immediate funds for the client while establishing a framework for the recovery of the remaining debt.
